1. Object
The purpose of this Agreement is to regulate the Terms and Conditions applicable to the reservation service of excursions through the platform www.boattriptenerife.com (referred to as “Platform”). www.boattriptenerife.com is the online platform dedicated to the publication and reservation of whale and dolphin watching excursions of Boat Trip Tenerife, whose trading company is Atlantic Yacht Charter S.L. with central office in Calle Marujita Diaz 22, Torremolinos, 29620, Malaga
2. Acceptance of conditions
Accessing www.boattriptenerife.com, and booking an excursion and / or services offered, implies the acquisition of the user’s condition and the declaration that you have read, understand and accept these Booking conditions, the Privacy Policy and the Conditions of Use, which form an integral part of this Legal Notice.
3. Booking of excursions
To make the reservation of the excursions offered by Boat Trip Tenerife (Atlantic Yacht Charter S.L.) you have to follow the process established in the platform. In particular, you have to select the excursion of your interest, the timetable, the number of participants, etc., and fill in the online booking form with the personal data requested. It is important that you review the information provided and correct any errors before making the confirmation of your reservation effective, once you click on the confirmation tab you will not be able to modify your data. By completing this form, you are indicating that you have read and understood the “description of the excursion” and accept the Terms and Conditions of Boat Trip Tenerife (Atlantic Yacht Charter S.L.). We recommend that you keep in mind the Cancellation Policy before making your reservation. Once your reservation has been paid, it will be processed by Boat Trip Tenerife (Atlantic Yacht Charter S.L.).
4. Confirmation of reservations
Depending on the booked excursion, you can receive the confirmation of itself immediately, or in a maximum period of 24 hours. Boat Trip Tenerife (Atlantic Yacht Charter S.L.) makes every effort to quickly update the availability of tours. However, Boat Trip Tenerife (Atlantic Yacht Charter S.L.) cannot guarantee the availability of all excursions for all proposed dates, due to weather conditions, full capacity, or any other cause of force majeure. This is the reason why it is possible that we contact the customer to propose a date change. In the exceptional case that Boat Trip Tenerife (Atlantic Yacht Charter S.L.) could not confirm your reservation, we will offer alternative dates that may be of interest to you. If you are not satisfied with the options we offer you, you will have the possibility to cancel and receive a full refund of the amount you have paid.
5. E-ticket
Once we confirm your reservation, you will receive by e-mail a personalized Boat Trip Tenerife (Atlantic Yacht Charter S.L.) E-ticket, which you must show at the pick-up point of the bus and at the dock in Puerto Colón. Your reservation will be accepted exclusively through the presentation of an E-ticket of Boat Trip Tenerife (Atlantic Yacht Charter S.L.). Boat Trip Tenerife (Atlantic Yacht Charter S.L.) will provide you with electronic copies of the corresponding E-ticket for each reservation made. Please note that each reservation has an independent E-ticket. It is your responsibility to keep the E-ticket and present it to the staff of Boat Trip Tenerife (Atlantic Yacht Charter S.L.) before starting the excursion, with a valid ID Card. The bonus may be invalidated if the above is not fulfilled.
6. Prices, inclusions and exclusions
The price of the excursions offered by Boat Trip Tenerife (Atlantic Yacht Charter S.L.) include IGIC and any other tax that is applicable at the current rate at the time you book the excursion. The price includes everything that is detailed in the “Included” section in the description of each excursion. Prices do not include tips or drinks, food or any other not specifically included in the “Includes” section of the excursion description.
7. Payments
In order to book an excursion through the Platform, you must pay the price indicated in the description of each excursion at the time of making your reservation. In case you have a discount code for Boat Trip Tenerife (Atlantic Yacht Charter S.L.), this discount will apply when you enter your code in the corresponding field of the form of your reservation data. You can pay your excursion with credit or debit card and through PayPal.
You will not be charged a fee or commission for processing the charges of your reservation with card. Your payment details (for example, card number, expiration date, etc.) will be processed in a secure way using an SSL security protocol, being only used to do the procedure corresponding to your purchase or the refund in the case of cancellation. Boat Trip Tenerife (Atlantic Yacht Charter S.L.) does not store your payment details or have access to them, only you and the entities that process the payment in a safe and reliable way, will have access to them. In the case that you do not pay the booked excursion or REVOQUES the payment, Boat Trip Tenerife (Atlantic Yacht Charter S.L.) will omit any possible claim for the benefits of the service. If you pay your reservation with a different currency to the euro, your bank or card company may charge fees for converting your currency payment to Euros, which will cause differences between the amount charged by Boat Trip Tenerife (Atlantic Yacht Charter S.L.) and the final amount to be paid will be charged to your bank account or that will appear on your credit or debit card statement.
8. Modifications and rectifications of reservations
To request modifications or rectifications of your reservation, write to boattenerife@gmail.com (specifying the reservation number, your name and the date of the booked excursion). We will respond to your request as soon as possible.
9. Cancellations and refunds
If you need to cancel a booked excursion or request a refund, you must do it sending an email to boattenerife@gmail.com with the reservation number, name and date of the excursion. The information of the cancellation policy of each excursion is detailed in the description of the excursion itself and in the E-ticket of your reservation. However, in the case of not being specified or there is an obvious error in the cancellation policy, cancellations and refunds will be governed according to the following cancellation policy:
If you cancel your reservation:
- 7 days before starting the booked excursion (Tenerife local time), you will be refunded 100% of the amount paid.
- Between 6 days and 48 hours before starting the booked excursion (Tenerife local time), you will be retained 50% of the amount paid and you will be refunded the other 50% of the amount.
- Less than 48 hours before starting the booked excursion (Tenerife local time), 100% of the amount paid will be retained, so you will not be the right to any refund.
These conditions will also apply to cases of waiver or not presentation.
The corresponding refund will be made between 24 and 48 hours from the cancellation of the excursion in the same payment method with which you paid the reservation, which will be notified to you through an email. Once the order is given, refunds made with debit / credit card can take 5 to 7 working days to appear reflected in your bank account and 30 days in the case of some foreign cards. Payments made through Paypal will be paid in less than 24 hours.
10. Change or Cancellation of an excursion by Boat Trip Tenerife (Atlantic Yacht Charter S.L.) and their collaborators
Boat Trip Tenerife (Atlantic Yacht Charter S.L.) reserves the right to cancel a particular excursion without adhering to the established cancellation period if weather conditions or any other cause endangers or make the excursion impossible or much more difficult. In this case, Boat Trip Tenerife (Atlantic Yacht Charter S.L.) will notify you by email about these changes or cancellations and you will be proposed, or another date for the realization of the excursion that may be of interest to you. If it is not possible to set another date or other excursions that we propose you which are not acceptable for you, you will be the right to the refund of 100% of the amount of the reservation, and any compensation for damages or other claims shall be excluded.
11. Applicable Laws and Competent Jurisdiction
You accept that the legislation applicable to the operation of these conditions is the Spanish. The Judges and Tribunals of Torremolinos, Malaga, shall be competent to hear the differences arising from the interpretation or application of this contract.
12. Modification of the present conditions and duration
Boat Trip Tenerife (Atlantic Yacht Charter S.L.) will be able to modify at any time the conditions determined here, being duly published as they appear here. The validity of the mentioned conditions will depend on their exposure and will be in force until they are modified by others duly published. Boat Trip Tenerife (Atlantic Yacht Charter S.L.) reserves the right to modify the characteristics of the excursions and the services offered without prior notice.
